Terms of Service

1. Eligibility and accounts

You must be at least 13 to use Oriva. To buy or sell through the marketplace, you must be able to enter a binding agreement in your location or use Oriva with the involvement of a parent or legal guardian.

You are responsible for accurate account information, safeguarding your credentials, and activity under your account. Tell us promptly if you suspect unauthorized access.

2. Oriva's marketplace role

Oriva operates a marketplace that helps customers discover and purchase coffee from independent roasters. Unless a listing expressly states otherwise, the roaster is responsible for the coffee it lists, packs, and fulfills. Oriva facilitates discovery, checkout, payment processing, seller transfers, and marketplace support.

Approval on Oriva means a seller completed the applicable marketplace review; it is not an endorsement or guarantee of every product, statement, or future action by that seller.

3. Orders, pricing, taxes, and fees

Product price, shipping, estimated or final tax, discounts, and total charges are shown during checkout. By placing an order, you authorize the displayed charge. Prices and availability may change before checkout is completed.

Oriva may charge sellers a disclosed platform commission. Payment processing is provided by Stripe and is subject to Stripe's applicable terms. We may cancel or refund an order when inventory is unavailable, payment cannot be completed, fraud is suspected, or fulfillment is not possible.

4. Shipping, delivery, returns, and refunds

Orders containing products from multiple roasters may arrive in separate shipments and may include shipping charges calculated per roaster. Delivery dates are estimates unless explicitly guaranteed.

Roasters are responsible for packing and shipping their products and providing accurate tracking when available. Returns, replacements, cancellations, and refunds are subject to the policy shown at purchase, product condition, seller participation, and applicable law. Contact Oriva if an order is missing, damaged, incorrect, or materially different from its listing.

5. Seller responsibilities

Sellers must be approved before using seller tools or publishing products. Sellers must provide accurate business, payout, public-profile, inventory, fulfillment, shipping, tax, and product information.

  • Only list products the seller is authorized and able to sell.
  • Maintain safe products and comply with labeling, food, consumer-protection, tax, and shipping requirements.
  • Keep inventory current and fulfill accepted orders promptly.
  • Protect private customer and delivery information and use it only for fulfillment and support.
  • Do not manipulate reviews, purchases, recommendations, Passport progress, or marketplace metrics.

Seller payouts may be delayed, reversed, or withheld when required for refunds, disputes, suspected fraud, legal compliance, or payment-provider rules.

6. Reviews and community content

You retain ownership of content you submit. You grant Oriva a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and distribute that content as needed to operate and promote the service.

Content must reflect genuine experiences and may not be unlawful, deceptive, abusive, infringing, sexually exploitative, spam, or designed to manipulate marketplace trust. We may moderate, limit, or remove content and accounts to protect users and the service.

7. Acceptable use

You may not bypass access controls, probe or attack the service, scrape at disruptive scale, introduce malicious code, impersonate others, abuse promotions, reverse payments fraudulently, access another seller's data, or use Oriva in violation of law or another person's rights.

8. Beta services and availability

Private-beta features may change, be incomplete, or become temporarily unavailable. We may limit invitations, regions, devices, sellers, products, or functionality while the service is being tested. We do not promise that every beta feature will become generally available.

9. Intellectual property

Oriva's software, design, trademarks, branding, and original content are owned by Oriva or its licensors. These Terms provide a limited, personal, revocable right to use the service; they do not transfer ownership of Oriva intellectual property.

10. Disclaimers and responsibility

To the extent permitted by law, Oriva is provided on an "as available" basis. We do not guarantee uninterrupted operation, a particular taste match, delivery time, seller performance, or outcome from using the service.

Nothing in these Terms excludes rights or remedies that cannot legally be excluded. To the extent permitted by law, Oriva is not responsible for indirect, incidental, special, consequential, or punitive damages arising from use of the service.

11. Suspension, termination, and changes

You may stop using Oriva and request account deletion. We may restrict or terminate access when reasonably necessary for security, legal compliance, marketplace integrity, nonpayment, or violation of these Terms. Provisions that by their nature should survive will remain effective.

We may update these Terms as Oriva changes. We will post the revised version and update the effective date, with additional notice when required.
